Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the whisky tasting record service provided by tayst (the "Service"). Users shall use the Service only after agreeing to these Terms.

1. The Service is available only to persons aged 20 or over. Persons under 20 may not use the Service.

2. Users shall declare that they are aged 20 or over when they begin using the Service. The Service is not liable for any damage arising from a false declaration.

1. Using the Service requires signing in with a Google or LINE account.

2. Users shall manage their own accounts at their own responsibility.

3. The Service does not store users' names or email addresses on its servers. See the Privacy Policy for details.

1. Copyright in the tasting notes and pairing records recorded by a user ("User Content") belongs to that user. The Service does not acquire it.

2. User Content is visible only to the user who posted it. Individual posts are never disclosed to other users.

3. Users grant the Service a free, non-exclusive licence to use User Content for the following purposes.

• Creating statistical information from which individuals cannot be identified, and displaying it within the Service (such as trend analysis by bottle)
• Providing and publishing the statistical information in the preceding item to third parties
• Improving the Service and investigating defects

4. The statistical information in the preceding paragraph shall be created at a level of granularity from which individual posts cannot be reconstructed.

5. User Content remains on the Service after withdrawal and continues to be used within the scope of Paragraph 3. In that case, the display name is anonymised.

Users shall not engage in any of the following.

• Acts that violate laws and regulations or public order and morals
• Posting false information
• Defaming others or infringing the rights of others
• Placing an excessive load on the servers of the Service, or accessing it in bulk by automated means
• Collecting or reproducing the contents of the Service without permission
• Analysing, modifying, or reverse-engineering the Service
• Any other act that the Service deems inappropriate

1. The Service does not encourage drinking. Please drink in moderation and with due regard for your health.

2. Drinking during pregnancy or while breastfeeding, and drinking before or after driving a vehicle, are prohibited or restricted by laws and regulations.

3. The Service is not liable for any harm to health, accident, or other damage caused by drinking in connection with use of the Service.

1. Tasting notes and statistical information are based on the subjective evaluations of users.

2. They do not guarantee the quality, taste, or safety of any product.

1. The Service is at a proof-of-concept stage and may change its content, or suspend or terminate its provision, without prior notice.

2. The Service does not guarantee its availability or the preservation of User Content. Please understand in advance that data may be lost.

1. The Service is provided free of charge.

2. The Service gives no warranty whatsoever as to the accuracy, completeness, or usefulness of its content.

3. The Service is not liable for any damage incurred by a user through use of the Service. This does not apply where the Service has acted with intent or gross negligence.

1. The Service may change these Terms as necessary.

2. After a change, users will be asked to agree again. Users who do not agree may not use the Service.

3. Where a change is disadvantageous to users, a notice period shall be provided in advance.

1. These Terms are governed by and construed in accordance with the laws of Japan.

2. In the event of a dispute concerning the Service, the Tokyo District Court shall be the exclusive court of first instance, except where such an exclusive jurisdiction agreement is not permitted by applicable law.
